Terms of Service

2.1 Information Services

Trovara provides digital property intelligence, market analysis, and due diligence coordination for properties in Italy. Our services include:

• Property search, discovery and comparison tools
• AI-generated property reports on individual Italian properties
• Free regional market reports, subject to a daily limit per account
• Market data, rental yield projections, and investment analysis
• AI-assisted review of property contracts you choose to submit
• An AI assistant answering questions about buying property in Italy

2.2 Not Professional Advice

3.1 Account Creation

To access reports and certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information promptly
• Not create multiple accounts or impersonate others
• Not share account credentials or allow unauthorized access

3.2 Account Security

You are responsible for all activity under your account. Notify us immediately at security@trovara.io if you suspect unauthorized access.

3.3 Account Termination

We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for 3+ years (subject to GDPR retention policies). You may delete your account at any time from your account settings. Deletion erases your personal data as described in our Privacy Policy, except records we are legally required to keep — in particular payment records retained under German tax and commercial law (§147 AO, §257 HGB).

4.1 Pricing Structure

Our services are offered under the following pricing model:

• Free Tier: Limited property search, basic market data (no payment required)
• Single Property Report: €69 per report (individual property due diligence)
• 3-Report Bundle: €149 (€49.67 per report)
• 6-Report Bundle: €249 (€41.50 per report)

All prices are in EUR (€) and include applicable VAT for EU customers per the EU VAT Directive.

4.2 Payment Processing

Payments are processed securely via Stripe (PCI-DSS Level 1 certified). We accept major credit and debit cards, Apple Pay, Google Pay, and SEPA Direct Debit (EU). We do NOT store your card details.

4.3 VAT & Invoicing

All prices include applicable VAT for EU consumers. An invoice is issued by our payment processor, Stripe, and emailed to you once your payment is confirmed. We do not currently collect VAT identification numbers at checkout, so the reverse charge mechanism is not applied automatically. Business customers who need a VAT ID shown on their invoice should contact info@trovara.io.

4.4 Price Changes

We reserve the right to modify pricing with 30 days' notice via email and website announcement. Price changes do not affect already-purchased reports.

4.5 Money-Back Guarantee (voluntary)

In addition to the statutory rights described in Section 5, Trovara GmbH grants every purchaser a voluntary 14-day money-back guarantee on paid Individual Property Reports. This is a contractual promise, not a restatement of the law: because the purchaser waives the statutory right of withdrawal at checkout in order to receive the report immediately (Section 5), this guarantee voluntarily restores a comparable remedy.

• Duration and scope: 14 days from delivery of the report, covering every paid Individual Property Report, including reports generated from bundle credits.
• Who may claim: the purchaser of the report, using the email address the purchase was made with.
• Single reports: the full purchase price is refunded on request within the window. We may ask what was missing so that we can improve the product; the refund does not depend on that answer.
• Bundles (3-report and 6-report): a bundle is refunded in full within 14 days of purchase for as long as no report credits have been used. Once credits have been used, the guarantee applies per generated report — the purchaser states, within 14 days of that report's delivery, which question it failed to answer, and that report's pro-rata share of the bundle price is refunded. A stated reason is a condition of a per-report claim and is disclosed wherever the guarantee is advertised.
• How to claim: the claim form at trovara.io/guarantee, or an email to info@trovara.io with the subject “Money-Back Guarantee claim”.
• Settlement: receipt is confirmed by email and the refund is issued to the original payment method, in the original purchase currency (EUR), within 10 business days. Nothing has to be returned.
• Effect: a refund concerns only the report claimed for. The account and any other reports remain available.

Your statutory rights are unaffected. This guarantee is granted by Trovara GmbH in addition to the rights the law of your country gives you — including rights concerning defective digital content — and does not restrict them. 5.1 Right of Withdrawal (14-Day Cooling-Off Period)

IMPORTANT EXCEPTION: By purchasing a Single Property Report, you acknowledge that:

• You are purchasing digital content not supplied on a tangible medium
• Performance begins immediately upon payment completion
• You expressly waive your 14-day withdrawal right (Directive Art. 16(m))

This waiver is required because report generation begins immediately upon payment. Once generated, the report cannot be "returned."

5.2 Refund Policy

In addition to the voluntary money-back guarantee described in Section 4.5, refunds are available in the following cases:

• Technical failure preventing report delivery (full refund)
• Duplicate charge due to payment processing error (full refund)
• Material data errors acknowledged by us (case-by-case evaluation)

Where the guarantee in Section 4.5 applies, its 14-day window and claim process take precedence over this section. Other refund requests should be sent to support@trovara.io with details of the issue. Your statutory rights, including rights concerning defective digital content, are unaffected.

5.3 Report Delivery

Reports are generated as soon as your payment is confirmed and are typically ready within a few minutes. Your report is delivered to your account dashboard and sent to the email address you provided. Generation times can vary with data availability; if delivery fails for technical reasons, section 5.2 applies.

6.1 Third-Party Data Sources

Our reports aggregate data from multiple third-party sources including:

• Property listings & market analytics: CASAFARI
• Official valuations and recorded transactions: OMI and Agenzia delle Entrate (Italy)
• Cadastral and land registry data: OpenAPI.it
• Location intelligence and mapping: Google Maps Platform, OpenStreetMap
• Demographics and statistics: ISTAT (Italy), Eurostat
• Risk data: INGV (seismic), ISPRA (hydrogeological), EFFIS/JRC (wildfire), Vincoli in Rete and the Geoportale Nazionale (heritage and landscape constraints)
• Public investment: Italia Domani (PNRR)
• Economic indicators: FRED (Federal Reserve Bank of St. Louis)
• Interest rates and mortgage indicators: European Central Bank, Banca d'Italia
• Seismic classification: Dipartimento della Protezione Civile (OPCM 3274/2003)
• AI research and analysis: OpenAI, Anthropic, Perplexity, Google

We make reasonable efforts to ensure accuracy but cannot guarantee the completeness, accuracy, or timeliness of third-party data. Our Privacy Policy lists every processor that may receive personal data.

6.2 AI-Generated Content (EU AI Act Compliance)

Market valuations, rental projections, and investment analysis are generated using AI and statistical models. These are estimates only - actual results may vary. In compliance with the EU Artificial Intelligence Act (Regulation 2024/1689), all AI-generated content is clearly labeled. AI systems used include OpenAI (GPT-4o and related models), Anthropic Claude, Perplexity, and Google Gemini. See our Legal Disclaimer for full details.

6.3 Verification Responsibility

You are responsible for verifying all property information with:

• Listing agents or property owners
• Italian property lawyers (avvocati)
• Licensed surveyors (geometri/periti)
• Notaries (notai) for legal compliance

7.1 Our Content

All content, reports, software, logos, and trademarks on Trovara are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to:

• Access and use reports for personal property search purposes
• Download and save reports for your own records

You may NOT:

• Resell, redistribute, or sublicense reports
• Use reports for commercial purposes without written permission
• Scrape, crawl, or systematically extract data from our platform
• Remove copyright notices or proprietary markings

7.3 User-Submitted Content

When you submit content to Trovara (including notes, listing descriptions, or other text in the "Additional Information & Notes" field), you:

• Grant us a non-exclusive, royalty-free license to use, process, and incorporate this content into your property reports and analysis
• Confirm that you have the right to share this content and that it does not infringe third-party intellectual property rights
• Acknowledge that this content may be processed by AI systems to enhance your report analysis
• Understand that personal data within your submissions will be processed in accordance with our Privacy Policy and GDPR

Important: User-submitted content is used solely to enhance your individual report and is not shared with other users or used for commercial purposes beyond your report generation. Free-text notes pass through an automated filter that removes common patterns of personal data — email addresses, phone numbers, names and street addresses — before analysis. This filter reduces exposure but is not a guarantee of anonymisation, so please do not include personal data about yourself or third parties that the report does not need. Documents you submit to the Contract Reviewer are sent to our AI provider in full, only with your explicit consent, and are not filtered.

9.1 No Warranties

Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to:

• Merchantability, fitness for a particular purpose
• Non-infringement
• Accuracy, completeness, or reliability of data
• Uninterrupted or error-free operation

9.2 Exclusion of Damages

To the maximum extent permitted by law, Trovara GmbH shall NOT be liable for:

• Investment losses or financial damages
• Property purchase decisions or outcomes
• Errors, omissions, or inaccuracies in third-party data
• Service interruptions or data loss
• Indirect, consequential, punitive, or incidental damages

9.3 Maximum Liability Cap

Our total aggregate liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim (or €100, whichever is greater).

9.4 EU Consumer Protection

10.1 Google Maps/Google Earth Additional Terms

By using Trovara, you agree to be bound by: Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy.

10.2 Google Services Used

The following Google Maps Platform services are integrated into Trovara:

• Google Maps JavaScript API (interactive maps)
• Google Maps Static API (static map images)
• Google Places API (amenity and point-of-interest data)
• Google Street View Static API (street-level imagery)
• Google Distance Matrix API (travel time calculations)
• Google Solar API (building solar potential analysis)
• Google Air Quality API (environmental air quality data)
• Google Address Validation API (address verification)
• Google Geocoding API (coordinate resolution)

10.3 Content Restrictions

Google Maps content displayed in our reports (including map imagery, street view photographs, and location data) is provided by Google and is subject to Google's intellectual property rights. You may not:

• Use Google Maps content to train or improve machine learning or AI models
• Remove, obscure, or alter any Google attribution or copyright notices
• Systematically extract or cache Google Maps content beyond what is displayed in our reports

11.1 Applicable Law

These Terms are governed by the laws of Germany and the European Union, excluding conflict of law principles.

11.2 Jurisdiction

Disputes shall be subject to the exclusive jurisdiction of German courts. EU consumers retain the right to bring proceedings in their country of residence per EU Regulation 1215/2012.

11.3 Consumer Dispute Resolution

The European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. EU consumers can still obtain free assistance from their national consumer authority or their European Consumer Centre (ECC-Net).
